Article 4 Directions

Article 4 directions are a planning tool that removes permitted development rights which would otherwise enable specified classes of alteration, or changes of use to be made to an existing building without the need for planning permission. Where an Article 4 direction is in place, planning permission is required to undertake the specified alteration or change of use. 

Manor Royal, Maidenbower Business Park, Lowfield Heath, Three Bridges Corridor, and Tilgate Forest Business Centre

On 26 July 2021, Crawley Borough Council made Directions under Article 4(1) of the Town and Country Planning (General Permitted Development) Order 2015 (as amended). When in force, the Article 4 Directions will remove the Class MA permitted development right. This will mean that planning permission will be required where a change of use is proposed from Use Class E (commercial, business or service) to Use Class C3 (residential). The Article 4 Direction will apply to the Maidenbower Business Park Main Employment Area.

The council has chosen to pursue non-immediate Article 4 Directions, which are subject to a 12 month notification period, including a statutory period during which feedback is invited. If you would like to comment on the Article 4 Directions, representations are invited in writing between 26 July 2021 and 29 October 2021.

Subject to consideration of the feedback received, it is intended that the Directions will come into force on 1 August 2022.

Change of use from dwellinghouses to houses in multiple occupation

On 13 May 2021 we made 10 Article 4 directions relating to 10 areas at the following locations within Crawley:

  • Aintree Road & Epsom Road, Furnace Green
  • Arden Road, Furnace Green
  • Ardingly Close, Ifield
  • Beverley Mews, Three Bridges
  • Caburn Heights, Southgate
  • Farmleigh Close, Pound Hill
  • Rillside & Winterfold, Furnace Green
  • Ringwood Close, Furnace Green
  • Victoria Mews, West Green
  • Weald Drive, Furnace Green

 
A map of each area is provided with the relevant direction. The directions remove permitted development rights that allow change of use from dwelling houses (Class C3) to houses of multiple occupation of up to 6 individuals (Class C4). They are ‘non-immediate’, meaning that there is a delay before they are due to come into effect. For further background information and an explanation of why we are making these changes, see the report,  which was considered by the council Cabinet on 3 February 2021 and the meeting minutes.

The consultation for these Article 4 directions was held between Monday 17 May 2021 and Monday 14 June 2021.

We will consider the representations received during the consultation to decide whether to confirm the directions. Subject to feedback, it is intended that the directions will come into force on 15 June 2022.

Lowfield Heath, Maidenbower Business Park, Three Bridges Corridor, and Tilgate Forest Business Centre

We confirmed on 22 February 2021 directions at the following main employment areas under Article 4(1) of the Town and Country Planning (General Permitted Development) Order 2015 (as amended):

  • Lowfield Heath
  • Maidenbower Business Park
  • Three Bridges Corridor
  • Tilgate Forest Business Centre  

The directions remove permitted development rights that previously allowed change of use of buildings from office (Class B1a), light industrial (Class B1c) or storage and distribution centre (Class B8) uses to residential (Class C3) use without the need for planning permission. With the directions now in force, planning permission will be required where a change of use is proposed from office (Class B1a), light industrial (Class B1c) or storage and distribution (Class B8) to residential (Class C3) use.

Manor Royal specific Article 4 Directions

Offices (B1)(a) to Residential (C3), and Storage and Distribution (B8) to Residential (C3)

On 29 July 2016, we confirmed the making of Directions at Manor Royal under Article 4(1) of the Town and Country Planning (General Permitted Development) Order 2015. The Directions remove permitted development rights that previously allowed the change of use of buildings from Office (B1a) or Storage & Distribution (B8) to residential use (C3) without the need to obtain planning permission. The Article 4 Directions apply to the Manor Royal main employment area as identified on the Local Plan Map and as set out below. This means that inside the Manor Royal main employment area, planning permission is required where any change of use of buildings from Office (B1a) or Storage & Distribution (B8) uses to Residential use is proposed.

Light Industrial (B1c) to Residential (C3)

On 16 October 2017, we confirmed the making of a Direction at Manor Royal under Article 4(1) of the Town and Country Planning (General Permitted Development) Order 2015 (as amended). The Direction removes a temporary permitted development right that previously allowed the change of use of buildings from light industrial (B1c) to residential use (C3) without the requirement to obtain planning permission. The Article 4 Direction applies to the Manor Royal main employment area as identified on the Local Plan Map and as set out below. This means that inside the Manor Royal main employment area, planning permission is required where any change of use of buildings from light industrial (Class B1c) to residential (Class C3) use is proposed.

Land at Westfield Place

On 10 December 2004, we confirmed the making of a Direction at Land at Westfield Place under Article 4(1) of the Town and Country Planning (General Permitted Development) Order 2015 (as amended). The Direction removes permitted development rights that would otherwise allow the erection, construction, maintenance, improvement or alteration of a gate, wall, fence or other means of enclosure.
