Demolition Notices

The following provides advice on how to comply with the Building Act 1984 regarding notifications of intended demolitions. Applicants should also refer to the updated advice regarding the need for planning permission .

Section 80 of the Building Act 1984 requires anyone intending to demolish a building (or part of a building) to give advance notification about this to the local authority in which the building stands. Exceptions to this requirement are where the building is less than 1750 cubic feet, or if the demolition only involves internal parts of a building, or certain agricultural buildings.

The person intending to demolish the building must by law give advance notification in writing, specifying the address of the building concerned (preferably with a plan) and detail the demolition work to be carried out.

This notification form should be sent to Sussex Building Control, Parkside, Chart Way, Horsham, West Sussex RH12 1RL. This must be copied to the occupiers of any adjacent building as well as the gas and electricity companies supplying services to the building.

Having received a notification of intended demolition, the Council may respond by serving a formal Notice (section 81 of the Building Act). The Notice can include conditions about how the demolition can proceed e.g. the need for shoring up any adjacent building etc.

It is a legal offence to commence the demolition before the Council has formally responded, unless six weeks has elapsed since sending the notification of intended demolition.
